Terms of Use

These Terms of Use ("Terms") are an agreement between you and the LovyDays Team ("we", "our") about your use of the LovyDays app and website (together, "LovyDays"). By downloading or using LovyDays you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the app.

1. Who can use LovyDays

You must be at least 13 years old to use LovyDays. If you are under the age of majority where you live, you may use LovyDays only with the permission of a parent or guardian, who accepts these Terms on your behalf. You may not use LovyDays if the law where you live does not allow it.

2. Your couple room

• LovyDays connects you with exactly one partner in a private couple room. There is no public profile and no one else can see the room.
• Everything you add to the room, such as your name, photo, moods, memories, little notes, love letters, quick touches and a location you choose to share, is visible to your partner. Share only what you are comfortable sharing with them.
• Either partner can leave the couple room at any time from Manage Relationship. What happens to the room's data after that is described in the Privacy Policy.
• There is no username or password. Your access is tied to the app on your device, so if you lose the device or delete the app without a backup, we may not be able to restore your room.

3. Your content

You keep ownership of the photos, videos, voice recordings, text and other content you add to LovyDays ("your content"). You give us a limited, non-exclusive, royalty-free permission to store, process and deliver your content only as needed to run LovyDays for you and your partner, for example to sync it to your partner's device or make a photo smaller. We do not use your content for advertising and we do not sell it.

You are responsible for your content. Only add content you have the right to share, and do not add content of another person without their permission.

4. Acceptable use

When using LovyDays you agree not to:

• add content that is illegal, sexually exploits minors, threatens or harasses someone, or infringes someone else's rights;
• use LovyDays to track, monitor or control a person who has not freely agreed to it, or pair with someone's device without their knowledge;
• try to access another couple room, another person's data, or parts of our service you are not meant to reach;
• copy, modify, reverse engineer or resell the app, or interfere with its servers, except where the law expressly allows it;
• use automated means to create rooms, send touches or otherwise abuse the service.

We may remove content that breaks these Terms or the law, and may suspend access for someone who does. To report content or a misuse, write to support@lovydays.com.

5. Location and Journey

Sharing your location and Journey are optional. Positions, routes, distances and arrival times are estimates and may be delayed or wrong. Do not rely on LovyDays in an emergency or for navigation, and never use the app while driving. You can stop sharing at any time in the app.

6. LovyDays Plus

LovyDays is free to use. LovyDays Plus is an optional auto-renewable subscription that unlocks extra features such as Love Letters, Little Notes, Couple Cat Delivery and Video Memories.

• Plans and price. Plus is offered as a monthly and a yearly plan. The price and billing period are shown in the app before you buy, in your local currency.
• Payment. Payment is charged to your Apple Account (App Store) or Google Play account when you confirm the purchase. We never receive your card or payment details.
• Automatic renewal. The subscription renews automatically at the same price and for the same period unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the current period ends.
• Managing and cancelling. You can manage or cancel the subscription at any time in your App Store or Google Play account settings, or from Profile, then LovyDays Plus, then Manage subscription. Cancelling stops the next renewal; Plus stays active until the end of the period you have already paid for.
• Refunds. Purchases are processed by Apple or Google, and refunds are handled by them under their own policies. Apple refunds can be requested at reportaproblem.apple.com.
• One subscription for both of you. When either partner subscribes, both partners get Plus for as long as they stay together in the same couple room. If the couple room ends, the partner who did not subscribe loses Plus at that moment; the subscriber keeps it until it expires or is cancelled.
• Restore purchases. "Restore purchases" attaches a subscription bought with the same App Store or Google Play account to the LovyDays profile you are using. If that subscription is currently in use by another LovyDays profile, the app asks you first; moving it ends Plus for that other profile and its partner.
• Changes. Store price changes are announced by Apple or Google as their rules require. We may add, change or remove Plus features over time; if a change substantially reduces what Plus offers, we will tell you in the app.

7. Love Letters

A Love Letter is a private letter you write to your partner in the app. You can send it at once or schedule it for a day and time in your partner's local time.

• Paying for a letter. Love Letters are included with LovyDays Plus, and every letter you receive comes with one free reply. Otherwise you can buy a single letter as a one-time purchase. The price is shown in the app before you buy and is charged to your Apple Account (App Store) or Google Play account.
• What you buy. Each purchase adds one letter to your LovyDays profile, which is used when you seal a letter. An unused letter does not expire, has no cash value and cannot be moved to another profile. It is not brought back by "Restore purchases"; it stays with the LovyDays profile that bought it.
• Getting a letter back. If you cancel a scheduled letter before it is delivered, or the couple room ends before its delivery time, the letter is not delivered and the purchased letter or free reply it used is given back to you. A delivered letter cannot be taken back.
• Refunds. Refunds are handled by Apple or Google as described in section 6. If a letter purchase is refunded, an unused letter is removed and a scheduled letter it paid for is cancelled; a letter that was already delivered stays delivered.
• Limits. A letter cannot be edited once it is sealed. Its length, how many letters you can send each day or have waiting at once, and how far ahead you can schedule are shown in the app and may change.
• Delivery. A scheduled letter is delivered at the chosen time in your partner's local time, but it may arrive a few minutes late. Your partner needs a version of LovyDays that supports Love Letters to receive one.

8. Our app and your licence

LovyDays, including its design, artwork, text and software, belongs to us and our licensors. We give you a personal, non-transferable, non-exclusive licence to use the app on devices you own or control, for your own non-commercial use, under these Terms and the rules of the store you got it from.

9. Third-party services

LovyDays runs on services from other companies, including Apple, Google Firebase and Google Maps Platform. Your use of the App Store, Google Play and Google Maps is also subject to their own terms. We are not responsible for services we do not control.

10. Ending your use

You can stop using LovyDays at any time by leaving your couple room and deleting the app. Deleting the app does not cancel a Plus subscription; cancel it in your store account (see section 6). To ask us to delete your data, follow the Privacy Policy. We may suspend or end access for anyone who seriously or repeatedly breaks these Terms, and we may stop offering LovyDays with reasonable notice in the app.

11. Disclaimers

We work hard to keep LovyDays reliable, but it is provided "as is" and "as available". To the fullest extent the law allows, we make no promise that it will always be available, error-free or secure, that notifications or scheduled letters will arrive at the exact time, or that content will never be lost. Please keep your own copy of anything important.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of LovyDays. Our total liability for any claim relating to LovyDays is limited to the amount you paid us for LovyDays Plus and Love Letters in the 12 months before the claim. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.

13. Apple App Store

If you got LovyDays from the Apple App Store, the following also applies:

• These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for LovyDays and its content.
• Your licence is limited to using LovyDays on Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for LovyDays.
• If LovyDays fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for LovyDays.
• We, not Apple, are responsible for addressing any claims relating to LovyDays, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer-protection claims.
• We, not Apple, are responsible for investigating, defending, settling and discharging any third-party claim that LovyDays infringes that third party's intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows the latest version. If a change is significant, we will let you know in the app before it takes effect. By continuing to use LovyDays after a change takes effect, you accept the updated Terms.
